TERMS & CONDITIONS FOR INSURANCE COMPANIES

Please read this agreement carefully before signing up on the VIMAApplication. As a condition to and in consideration of using thisApplication, the user agrees to be bound by the terms of this Agreement.Use of or access to the VIMA Application shall constitute acceptance ofand agreement to be bound by this Agreement. THIS AGREEMENT “Agreement” is entered into by and between TripleAlliance Risk Solutions Ltd and any individual, corporation, association,agency, company, or other entity who uses the VIMA Application (the“User”).

  1. Access to the VIMA Application
    You are responsible for providing all hardware, software, telephone and otherequipment required to connect and access the application.

  2. User Conduct
    You agree to access and use the VIMA Application only for lawfulpurposes. That you have legal rights and permission to all uploadedcontent and your use of the Application will not violate any law orregulation. Triple Alliance shall be absolved of any law suits resultingfrom the violation of any operating or regulatory rule, policy orguideline while using the application.

  3. User Registration
    You may be required to register with the Application. You agree to keepyour password confidential and will be responsible for all use of youraccount and password.

  4. Intellectual Property Rights
    Unless otherwise indicated, the Application is our proprietary propertyand all source code, databases, functionality, software, websitedesigns, text and graphics on the Application and the trademarks and logos contained therein are owned or controlled by us or licensed to us.Except as expressly provided in these Agreement, no part of theApplication and no Content or Marks may be copies, reproduced,uploaded, posted, publicly displayed, encoded, transmitted orotherwise exploited for any commercial purpose whatsoever, without orexpress prior written permission.

  5. Prohibited Activities
    You may not access or use the Application for any purpose other thanthat for which we make the Application available. As a user of theApplication, you agree not to:
    1. Circumvent, disable or otherwise interfere with security-relatedfeatures of the Application, including features that prevent or restrictthe use or copying of any content or enforce limitations of theApplication and/or the Content contained therein.

    2. Engage in any automated use of the system, such as using scripts tosend comments or messages, or using any data mining, robots, orsimilar data gathering and extraction tools.

    3. Use the Application as part of any effort to compete with us orotherwise use the Application and/or the Content for any revenue-generating endeavour or commercial enterprise.
    4. Harass, annoy, intimidate, or threaten any of our employees or agentsengaged in providing any portion of the Application to you.

    5. Copy or adapt the Application’s software, including but not limited toFlash, PHP, HTML, JavaScript, or other code.

Please read this agreement carefully before signing up as an agent on theVIMA Application. As a condition to and in consideration of using thisApplication, the agent agrees to be bound by the terms of this Agreement.Use of or access to the VIMA Mobile Agent’s Application shall constituteacceptance of and agreement to be bound by this Agreement.   1. Purpose
    The purpose of this Agreement is to define how agents conducting vehicleinspections and valuations will conduct themselves while representing thecompanyThis Agreement also indicates the standards of integrity and conduct to bemaintained by agents at all time while performing their functions.

  2. Scope
    This document applies to all VIMA agents who are acting on behalf of thecompany in conducting motor vehicle inspection and valuation.

  3. Responsibilities
    All VIMA agents are required to implement and follow procedures laiddown by the company to guide them in effectively carrying out their jobfunctions.

  4. Limitation of Liability
    Under no circumstance is the company liable for any direct, indirect,incidental or consequential accidents or damages either to the agent or themotor vehicle arising from the conduct of inspection or valuation. Under the provision of this code of conduct, VIMA agents who have beenapproved to represent the company must conform to the followingrequirements:
    1. Authorizations, appointments and identification

    2. Inspection and investigation conduct

    3. Confidentiality

    4. Reporting

    5. Acting in accordance with organization policies and processes

    6. Periodic Review and Audit
  1. Authorizations, appointments and identification
    This requires that all agents acting on behalf of the company must confirmtheir appointment with the insured and provide a copy of their identity cardas an authorized agent before exercising their functions. Also, the agentmust ensure that the insured or the representative of the insured isavailable while carrying out an inspection or valuation assignment to avoidany false accusation of theft or damages.

  2. Inspection and Valuation conduct
    Agents conducting inspections and or valuations must carry out their workwithin stipulated framework and standards provided by the company. AVIMA agent must:
    • carry out their duties in a courteous and respectful manner, with minimumlevel of disruption as well as respect to the dignity and privacy of theinsured.

    • act professional and not engage in unnecessary interaction with theinsured

    • be as available as possible to accept inspection and valuation job whenalerted.

    • ensure that all accepted jobs are carried out within 24 hours of acceptingthe job and reports submitted accordingly.

    • on no account should an agent delegate any accepted inspection orvaluation task to a third party. Any inspection or valuation assignmentreceived at such a time that is inconvenient should not be accepted.

    • not be inactive for a period of two (2) months. The account of agents seenas inactive will be deactivated.

  3. Confidentiality
    All agents must ensure that any information gathered during the course ofan inspection or valuation assignment is kept confidential and undisclosedunder ANY circumstance to third parties.

  4. Reporting
    Agents conducting inspections and valuation assignments must reportfindings in an objective and transparent manner and not knowinglyunderstate or overstate the significance of reported conditions. Any false,overstated or understated findings reported by the agent for fraudulentpurpose will result to any or all of the following:
    • termination of agency contract

    • criminal liability

    • forfeiture of payment for previous work done

  5. Acting in accordance with organization policies and processes
    Agents conducting inspections, investigations or reviews must act inaccordance with all the codes of conduct, policies and procedures of thecompany. Failure to comply might result to termination of the agencycontract and or forfeiture of payment due.

  6. Periodic review and audit
    This code of conduct is subject to periodic review and audit.
